GENERAL TERMS AND CONDITIONS 

This web site makes available information on Luxury Ocean Vacation Ltd (LOV)– The offer of goods and/or services is conditioned on the user's ("User('s)" or "You(r)") prior acceptance of the terms and conditions and notices set forth herein and on other pages of the Site (collectively the "Terms").  

Personal use

All bookings made are for the personal use of the Client only

 Legal Capacity to make online bookings

The Client declares having the legal capacity to enter into the present agreement and to make the payment associated with the booking. If ever a minor is concerned, the parents/judicial guardians of the minor certify having the legal capacity to enter into the present agreement in their aforesaid capacities and for and on behalf of the minor.

 

Acceptance by Luxury Ocean Vacation (LOV)validating bookings

Luxury Ocean Vacation (LOV) will, upon receipt of a booking request, determine whether the request can be acceded to. 

The Client’s credit card being valid and the full amount due, successful transacted.

The Client paying via bank transfer to nominated, pre-determined bank account, by the due date, successful transaction.

If for any reason, the Client’s credit card cannot be debited with the amount due, or if the bank transaction is subsequently reversed, the booking will be cancelled unilaterally and as of right by Luxury Ocean Vacation (LOV).; without Luxury Ocean Vacation (LOV). having to fulfil any judicial and/or extra-judicial formality, 

The acceptance e-mail of Luxury Ocean Vacation (LOV). must be produced by the client upon check-in at the residence. The client may also be requested to produce proper identification on check-in at the residence (passport, ID, driver’s licence)

 Non-refundable / refundable deposits/Cancellation policy and cancellation fees

A non-refundable deposit of 20% of the total amount of the accommodation will be charged at the time of making the reservation.  The balance of 80% will be charged, using the same credit card details used to pay the deposit, and this will be processed 30 Days before the arrival date of the Client.  All bank transfer and cash payments must be reflected prior to the 30 days of arrival.

A refundable deposit of 250  Euros is payable prior to or on arrival date, prior to access of the rental.  A hold will be placed on the same credit card used for the booking.  This will be released, on condition that no amounts are due, after an inventory upon check out is completed, approxiamtely 48 hours.  The release back to the card will be determined by your bank’s regulations.

A cash deposit and bank transfer will be refunded on condition that no amounts are due, after an inventory upon check out is completed, by bank transfer or cash refund, only if possible.  

Peak Period policy 20 December to 08 January inclusive of both dates

Any bookings that fall within these dates, inclusive of reservations that start prior and / or end after.

ALL no-shows will be charged at 100% of the total amount of the accommodation. 

Cancellations, within 90 days in peak periods, within 30 days of arrival date of client will be charged at 100% and the credit card details used to pay the 20% deposit will be used to process the balance payment of 80%

All cancellations must be done in writing. The guest shall be liable for and pay a cancellation fee, as described at the time of booking.

No reservation is confirmed unless all payment condition requirement has been fulfilled. Failure to comply may result in the booking being cancelled without recovery.  

Reimbursements

In the event of a refund, the relevant amount will be transferred back to the same credit card used to make the original booking. Any booking charges applied will not be eligible for reimbursement.  

Breakage Deposits will be released, on condition that no amounts are due, after an inventory upon check out is completed, approximately 48 hours.  The release back to the card will be determined by your bank’s regulations.

A cash deposit and bank transfer will be refunded on condition that no amounts are due, after an inventory upon check out is completed, by bank transfer or cash refund only if possible. 

 Changes in the dates and number of guests of bookings

Any changes requested after a reservation has been confirmed, must be addressed in writing to the reservations team on resa@innlov.com

Any changes in dates or number of guests may result in additional charges. 

Any changes requested are subject to availability and subject to the payment policy being fulfilled.

 

Residence check-in and check-out times:

Residence check-in will be as from 14h00 up to 17h00 and Check-out of the Residence must be between 7h30 to 10h00 by latest unless prior arrangements have been made in writing to our Reservations Department. ONLY written confirmation of early check-in and late check-out will be considered and is subject to additional charges.  

Exceeding any check in or check out times can result in extra charges, including, but not limited to, early check in and late check out fees, an extra night charge being applied to your bill.

 

Compliance with occupancy description

The client undertakes to comply strictly with the residence occupancy description featured on the website in respect of the maximum number of persons and the adult/children classification that allows occupation of any specific room at any one time.Should additional guests occupy the residence, we reserve the right to charge accordingly.  We also reserve the right to issue instruction to vacate the residence.  In such case, no compensation or reimbursement shall be made, and Luxury Ocean Vacation (LOV) shall also not be responsible for any damages or prejudice if any. This will be applicable automatically and as of right, without Luxury Ocean Vacation (LOV)having to fulfill any judicial or extra-judicial formality.

 Use of rooms

The room/s shall be for the exclusive use of the client.

 The client agrees and undertakes to use the Residence responsibly. Any behavior contrary to laws, good morals and/or public order will result in Luxury Ocean Vacation (LOV)asking the client to vacate the residence. In such case, no compensation or reimbursement shall be made, and Luxury Ocean Vacation (LOV)shall also not be responsible for any damages or prejudice if any. This will be applicable automatically and as of right, without Luxury Ocean Vacation (LOV)having to fulfill any judicial or extra-judicial formality.

 

Compliance with the Residence regulations

All Residences are covered by regulations, of which a copy is available in all the Residences.. The client undertakes to comply strictly with these regulations, failing which, Luxury Ocean Vacation (LOV)will have the right to ask the client to vacate the residence and leave the complex. In such case Luxury Ocean Vacation (LOV)shall make no compensation or reimbursement, and Luxury Ocean Vacation (LOV)shall also not be responsible for any damages or prejudice if any. This will be applicable automatically and as of right, without Luxury Ocean Vacation (LOV)having to fulfill any judicial or extra-judicial formality.

 

Registration forms

Prior to  check-in, the client will be required to fill in and sign the online check-in form.  The check in form must be completed prior to admission to the residence.

Damage or removal of residence property

Guests will be held responsible for any damages to the property or any furnishings, fittings and equipment therein by any act or omission of the guest, his / her invitees, subcontractors or guests.  Should the damage come to light after the guest has departed, Luxury Ocean Vacation (LOV) reserves the right to charge the guest credit or debit card.

Luxury Ocean Vacation (LOV) reserves the right to charge the guest the full replacement costs of any items that are removed from the residence.  

Luxury Ocean Vacation (LOV) reserves the right to take action against any guest found to have tampered / interfered with and fire protection equipment throughout the property, including detector heads in public areas and bedrooms, break glass points and fire extinguishers.  Any costs incurred by Luxury Ocean Vacation (LOV) due to their actions, even after departure, will be charged to the guest and additionally may be asked to leave the residence.  

 

Lost Property

Should any personal affects or goods be left behind, Luxury Ocean Vacation (LOV) accepts no responsibility for these items.  

 

Use of the Swimming pool and Jacuzzi

Use of the swimming pool and Jacuzzi is entirely at the sole risk of the guest, his / her invitees, subcontractors or guests.  Luxury Ocean Vacation (LOV) accept NO responsibility for any damages or injury or death resulting from use of the swimming pool or jacuzzi.

 

Personal Injury on the Property

Luxury Ocean Vacation (LOV) accept NO responsibility for any damages or injury or death at the residence. 

 

Foods and Beverages

Food and beverages are available in the residence.  A list of prices are provided.  All items used will be charged for daily.

Use of facilities and outside services

Any use of outside services, not approved by Luxury Ocean Vacation (LOV), contracted by the guest independently, may be refused or granted consent at its sole discretion without being liable to the guest for such decision.

The guest, if engaging the services of persons outside the employ of the residence, shall indemnify Luxury Ocean Vacation (LOV) against any loss or damage to property or death or illness or injury to any person(s) and against all claims, demands, proceedings and damages arising as a result therto.

Luxury Ocean Vacation (LOV) may in it absolute discretion refuse access to any third party service provider in appropriate circumstances.

 

No smoking policy

Smoking is strictly prohibited inside any property.  Failure to adhere to this may result in the guest be charged for the necessary cleaning charges and loss of revenue due to the cleaning required.  

 

Pets

No Pets are allowed at the residence.

 Photographs on the website

Photographs shown on the website are for information purposes only. Although every effort is made to ensure that the photographs, graphic images and text used to illustrate the displayed property and features provide as accurate an impression as possible of the accommodation offered, variations may occur, in particular as a result of any change of feature or renovation. The client may not make any claim in that respect.

Force Majeure

Luxury Ocean Vacation (LOV) shall not be in breach of this agreement if it does not provide services under this agreement, and it shall be entitled to cancel a booking if it is no longer able to provide accommodation, due to one or more of the following circumstances;

  • Any part of the residence is closed due to fire, alteration or redecoration.
  • There is a failure to supply Luxury Ocean Vacation (LOV) residences with gas, electricity, or water outside of the hotels control;
  • The residence is unable to fulfill the booking as a result of industrial action by its staff or of its suppliers;
  • Fire, lightning, explosion, riot or civil commission, malicious damage, storm, cyclone, burst pipes, earthquakes, tsumani, included yet no limited to these events, may result in the residence being unable to meet the booked facilities.
  • The reseidence or any part thereof is designated for alternative use.

Exclusion and limitation of liability

Luxury Ocean Vacation (LOV)shall not be liable in case of non-fulfillment or inadequate fulfillment of the services or sale of the goods in the event of force majeure, actions of third parties, or actions/omissions of the Client.

 

Luxury Ocean Vacation (LOV) shall not be liable for effects lost by the Client and or due to theft or any other mishap.

 

Luxury Ocean Vacation (LOV)shall not be held responsible for the non fulfillment or inadequate fulfillment of any service or sale of any good, except in case of gross fault or gross negligence on its part, including the general terms and conditions. The client shall furthermore not have the right to make any claim for indirect or consequential damages.

No warranty on internet services

Luxury Ocean Vacation (LOV)does not make any warranty in relation to internet access, or to availability or non availability of internet services. Luxury Ocean Vacation (LOV) further does not make any warranty with regard to the absence of viruses on internet network.

Luxury Ocean Vacation (LOV) makes no warranty that the website will be operational at all times. The client shall not have the right to make any claim to Luxury Ocean Vacation (LOV) if the website (including the internet booking pages and information) is temporarily or permanently out of use or not operational.

While every precaution has been taken, Luxury Ocean Vacation (LOV) cannot ensure that a third party will not unlawfully access private details and advises the Client to take all necessary precautions. Luxury Ocean Vacation (LOV) suggests that the client does not permit others to access his personal codes or passwords. Luxury Ocean Vacation (LOV) shall accept no responsibility in case of access by third parties to the client’s private details, including personal codes or passwords, or the credit/debit card details. The client accepts the inherent risks of using the present website.

 Time-limit to make claims – where claims are to be made

All claims made by the Client in relation to the services or in relation to his stay shall imperatively be made in writing to Luxury Ocean Vacation (LOV) within 24 hours from the event giving rise to the claim. Failure to do so by the client shall render the claim inadmissible. All claims must bear the mention: ‘Booking Claim + Reservation Number/Full Clients name’ in the mail subject.

Payment

The client shall provide his credit card details as a guarantee of the booking.

In the event of a no show or of a cancellation, Luxury Ocean Vacation (LOV)shall have the right to debit the card used by the client in the internet booking with the amount of cancellation fees.

 

Star Rating

Star ratings are indicated as a general guide. Star ratings may differ according to the country where the Luxury Ocean Vacation (LOV)residences are located and are not necessarily the official local rating. Standards can vary between a Luxury Ocean Vacation (LOV)Residence and any other accommodation of the same category in the country.

 

Right to relocate the Client

In the event of unavailability of any property booked by the client, Luxury Ocean Vacation (LOV)reserves the right to relocate the client to another Luxury Ocean Vacation (LOV). property of an equivalent category, without the client having the right to make any claim for compensation.

 

Services/activities provided by independent contractors at IOT. Residences

In many Luxury Ocean Vacation (LOV) Residences, persons independent from Luxury Ocean Vacation (LOV) deliver services and/or activities. The Client acknowledges that, if the said services/activities happen to be available at the residence or from the residence, they are not carried out under the responsibility of Luxury Ocean Vacation (LOV) but under the responsibility of independent contractors. The Client may be requested to sign registration/disclaimer forms prior to be entitled to make use of the said services/activities. The Client also undertakes not to make any claim to Luxury Ocean Vacation (LOV) and to its investors, property owners, directors, managers and/or employees, in case of problems/damages in the course of or related to the said activities/services.

 

Cyclones/bad weather conditions/transport problems

If the Client cannot reach the residence due to cyclonic or bad weather conditions, or due to transport problems, in Mauritius or abroad, the Client shall be bound to pay for the day/days not used by him.

If the Client cannot leave the Residence due to cyclonic or bad weather conditions or due to transport problems, in Mauritius or abroad, Luxury Ocean Vacation (LOV) shall try to find accommodation for him at any of its properties, without Luxury Ocean Vacation (LOV) giving any guarantee in that respect. In such case, the Client shall have to pay up front for the additional stay and at the prevailing rates.

Passports and visas

Prior to making the internet booking, the Client declares being in possession of a valid passport, with a validity period sufficient to enable him to complete his stay at the residence. It is also the Client’s responsibility to obtain all visas which are necessary to enable him to effect his stay at the residence. Luxury Ocean Vacation (LOV)shall not be held liable in case of failure to obtain a valid passport or a valid visa, and the absence of a valid passport or a valid visa shall not be considered as “force majeure”.

 Site Content

The Site and all content contained therein including, images, photographs, logos and other materials, and the copyrights, trademarks, trade dress and other intellectual property rights in such materials are owned by the Company or its Licensors, including Luxury Ocean Vacation Ltd and its affiliates and certain other trademarks appearing on the Site are used by the Company under license from Indian Ocean Travels. The Site or any portion of this Site may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose that is not expressly permitted the Luxury Ocean Vacation (LOV) management  company.

The Site may contain links to other websites. The Company provides such links for your convenience only and is not responsible or liable for the actions of such independent websites. Development/ modification of the general terms and conditions of internet bookings and of the website

 

Luxury Ocean Vacation (LOV)may change or add to these general terms and conditions at any time. In this case, the new version of the general terms and conditions will be published online by Luxury Ocean Vacation (LOV). From the time it is published online, the new version of the general terms and conditions will apply automatically to all clients.

 

Governing Law

Any disputes arising out of or related to the Site or these  Terms & Conditions shall be handled individually without any class action, and shall be governed by, construed and enforced in accordance with the laws of registered company country, excluding its conflict of law rules.
